The parties can agree an adjudicator. If they do not, within ten working days of the notice of adjudication, the unpaid party asks the Director of AIAC to appoint one. The Director appoints within five working days. The adjudicator then confirms acceptance.
The claimant then serves the adjudication claim, the respondent serves the adjudication response, and the claimant may reply. Our instruction is to prepare those documents in compliance with the Act, and to observe the periods for service.
The Asian International Arbitration Centre has reported that a substantial proportion of decisions have been in favour of claimants. That is AIAC’s figure. It is not a representation as to the outcome of a particular reference, which turns on the contract, the claim and the response.
